Terms and Conditions

Please read these terms and conditions carefully before you use the vet.gb. com website. You must indicate that you agree to these Terms and Conditions before you may make any purchase from the site. If for any reason you do not fully agree to these Terms and Conditions you are requested not to use the site.

Interpretation

In these Terms and Conditions the following words shall have the following meanings;

"Website" or "site" shall mean the Mayfield Vet Nutrition website.

"Us", "we", "our" or "the Company" shall mean Springing Dragon Ltd.

"You" and/or "your" shall mean any person using the site or accessing information held on the site, whether that person is registered as a user or not.

"Person" shall mean any individual, partnership, company, organisation, firm, trust, government body or corporation.

"User" and or "users" shall mean any person (as defined above) using the site either individually or collectively.

"Purchaser" shall mean any person (as defined above) who purchases goods from the Company.

"Contract" shall mean the contract between the Company and the Purchaser for the sale and purchase of goods. The Contract shall be deemed to incorporate these Terms and Conditions.

"Goods" shall mean any goods agreed in the Contract to be supplied to the Purchaser by the Company, including any part or parts of them.

"information" and/or "advice" mean any information or advice you receive when accessing our website.

The words "include" and/or "including" will be construed without limitation

Words indicating gender include all genders

Plural words shall include the singular and vice versa

Within these Terms and Conditions any reference to any statute or statutory provision shall be construed as a reference to such statute or statutory provision as from time to time amended, modified, extended, consolidated, re-enacted or replaced.

Within these Terms and Conditions headings are given for ease of use only and shall not affect the construction or interpretation of these Terms and Conditions.

Registration

To register with this site you must be 18 or over and capable of entering into a legally binding contract.

Following registration with the site you shall be responsible for the security of your own account and password. You shall be responsible for any purchase or other activity made on your account. The Company shall not be liable for any loss or damage which occurs as a result of your failure to protect the security of your account and password.

The Contract

The Contract shall be on these Terms and Conditions to the exclusion of all other Terms and Conditions, including any Terms and Conditions which are purported to be applied or included by the Purchaser. Terms and Conditions contained in the confirmation e-mail, purchase order or any other document, transmission or communication will in no event form any part of the Contract. The Contract shall be concluded in English.

Price and Description of Goods

Unless otherwise agreed the price and description of Goods shall be the price and description given on the website when you place your order. Prices are given inclusive of VAT. A charge for delivery will be applicable.

We take great care to provide an accurate description and price of Goods on our website; however in the event of discovering an error in such pricing and/or description the Company shall notify you of this. The Company reserves the right to cancel any order resulting from material or typographical errors in the pricing or description of Goods.

Ordering of Goods

When you order Goods from the website you are offering to purchase Goods from the Company subject to these Terms and Conditions. The Company reserves the right to decline such an offer at our own discretion. The Company will accept an offer to purchase Goods wherever possible to do so and will send an e-mail to confirm this. This e-mail confirmation of acceptance of order concludes the Contract between Purchaser and the Company.

The e-mail confirmation will be deemed to have been received by you when you are able to access it.

Occasionally the Goods you offer to purchase may be unavailable. Where the Company is not able to accept your order we will notify you via e-mail and you may cancel your order and will receive a refund for any sum paid for the Goods within 30 days.

Prescription Only Medicines (POMs)

The Company will not dispatch Prescription Only Medicines unless we are in receipt of an applicable and verifiable veterinary prescription. Such medicines cannot be returned except to rectify a dispatching error or in the event of an Official Recall of a product.

Veterinary prescriptions should be posted to our business address within 30 days of your ordering on the website. If we fail to receive such a prescription within 30 days we will cancel your order and terminate the Contract in respect of your order. Any sums paid by you in respect of the order will be refunded to you within 30 days.

Payment

Payment is due at the time of processing the order on the website. Payment is made via the Paypal system so we never store any of your credit card details. No payment shall be deemed to have been received and no delivery of Goods will take place until cleared funds have been received by the Company.

Delivery of Goods

You should receive non-prescription Goods within 30 days from the day following your order, but the Company will endeavour to deliver non-prescription Goods within seven working days of receipt of your order. If we are unable to supply Goods for any reason within 30 days we will notify you via e-mail and provide a date for the expected delivery of Goods. If this revised date is not acceptable then you may cancel your order should you wish to do so. The Company provides estimated dates for delivery only and will not be liable for the consequence of any delay in fulfilling the order howsoever caused.

Warranties

The company warrants that Goods are of satisfactory quality. The Company's liability under this warranty shall be limited to replacing or repairing the Goods or providing a refund of the price of the Goods.

Should you wish to make a claim under this warranty the Purchaser should provide written notice to the Company within 3 days of receipt of the Goods or within 24 hours in the case of Goods damaged in transit otherwise the Company shall accept no liability.

Following the provision of notice as described above, the Company shall not be liable for any breach of warranty if the Purchaser makes further use of the Goods, repairs or alters the Goods in any way without the express written consent from the Company.

The Purchaser accepts that the Company's liability in respect of unmerchantable Goods shall not in any event exceed the actual price of the Goods paid by the Purchaser. The Company accepts no liability for any consequential loss whatsoever, howsoever this may be caused arising from any defect in the Goods or their failure to correspond to any description or representation or for their unsuitability for any purpose.

Ordering Errors, Cancellation of Orders and Returns of Unwanted Goods

You can change or modify your order easily up to the point that you proceed to payment on the site.

If you decide to cancel your order you may do this within seven working days of the receipt of the Goods, except for prescription only medicines where this is not allowed legally.

Cancellations of orders should be notified to the Company via e-mail. Once notification of the cancellation has been received by the Company, a refund for any sum paid for the Goods will be made within 30 days. Delivery charges cannot be refunded for unwanted Goods once they have been dispatched.

If you cancel your order following the receipt of Goods you must return the Goods in good condition, they must be in the manufacturers original packaging, unopened and in their original new condition. Associated packaging and any promotional material should also be returned with the Goods.

Goods are returned at the Purchaser's own risk until received by the Company. Unwanted Goods are returned at the Purchaser's own expense. Proof of postage shall not be accepted as proof of receipt of Goods.

Returned Goods will not be accepted unless they were originally supplied by Mayfield Vet Nutrition.

Return of Faulty or Damaged Goods

The Purchaser may return any damaged or faulty Goods and the Company should be notified of this via e-mail within 7 working days beginning the day after you receive such Goods. Details of faults or damage should be provided and such Goods may be returned by the Company to the supplier whose decision on such Goods will be final. A refund for damaged or faulty Goods will be made within 30 days of notification together with a refund of the cost of postage for the return of the Goods.

Limitation of liability

The Company's liability in contract, tort or otherwise arising from the Contract shall in no event exceed 1000. The Company shall in no event be liable to the Purchaser for any consequential, indirect, or economic loss or damages (howsoever arising) which may arise out of or in connection with the Contract.

Disclaimer

Any information or advice is provided on the website for educational purposes and as a guide only. No liability shall be accepted for any omission, errors or misleading information contained in the website.

To the extent permitted by applicable law the Company disclaims all warranties express or implied as to the accuracy of the information contained in this website. The Company does not accept liability for any loss or damage arising from the use of any information or advice contained in this website.

Where any other company, organisation or individual is mentioned on our website this shall not imply approval or warranty of that company, organisation or individual.

The Internet

The Company does not accept any liability for any interruption of service or access to our website, or for the transmission of viruses or other malicious code which may be transmitted via our website. This is because we have no control over the internet.

Users are advised to beware of any suspicious e-mails which may appear to be from our website asking for credit card details; if in receipt of such an e-mail you are advised not to give out such information and to contact us immediately.

Where links to other websites are provided on the site the Company accepts no liability for your use of such sites which are beyond our control.

Indemnity

You agree to indemnify and hold us and any agents harmless from and against all and any expenses, losses, liabilities, damages, costs or expenses??x incurred or suffered and any claims or legal proceedings which are brought or threatened, in each case arising from your use of, or conduct on, this site and/or a breach of any of these Terms and Conditions.

Registration and Uploading

We will store your registration data for the purpose of enabling you to use specific facilities of the site and communicating with you by email. If you upload material to the site (e.g. images or photographs) you assume all responsibility for your upload. You agree to ensure that you do not upload any illegal image or any image which you do not own. We may delete any of your personal or other data at our discretion without warning. If you submit image(s) for a pet then those images may be used in a response to any questions you may submit concerning that or other pets.

Privacy

We have a no-spam policy and we commit that we will not knowingly or intentionally share your personal information with any third party except where necessary to comply with the law. You may receive email updates from us if you have agreed to this; you may choose to opt out.

Changes to these Terms and Conditions

We reserve the right to make changes to any part of this site. Due to our policy of update and improvement it may therefore be necessary to change these Terms and Conditions. If we do change the terms of these Terms and Conditions, we will update the date at the top of this page. If you use the site after we have published such changes, you will be agreeing to be bound by those changes. If you do not agree to be bound by them, you should not use the site.

Force Majeure

Under the circumstances of a Force Majeure event (such as war, industrial disputes, fire etc) any obligations under these Terms and Conditions shall be suspended until the event has ended.

General

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Users of the website agree to submit to the exclusive jurisdiction of the courts of England and Wales.

If any part of these Terms and Conditions is deemed to be unlawful or unenforceable, that part shall be deemed severable and the remaining Terms and Conditions shall remain in full force and effect.

We reserve the right to change these Terms and Conditions from time to time at our own discretion and without notice.

Your legal rights are not affected by these Terms and Conditions.

Privacy Policy

Mayfield Vet Nutrition values and respects your privacy. Any information which you choose to supply to us is used only to provide you with our own services and products. We never disclose your information to third parties. Your information is collected, stored and used in compliance with the Data Protection Act 1998.

We use the Paypal system (which encrypts all the information) to process all payments so your card details are never available to us or collected by us and cannot be seen, stored or used by ourselves.

Our website uses cookies to welcome registered users who have logged in to our site and to track your current session on Mayfield Vet Nutrition only, (to make life easy for you when you are filling your shopping basket for example), they are not used for any type of profiling activity.

We may from time to time offer services such as newsletters, reminders and promotions. If you do not wish to receive such services you can opt out of these at any time.

Indemnity

When using this site, submitting questions or other material to this site you agree to indemnify and hold us and any agents harmless from and against all and any expenses, losses, liabilities, damages, costs or expenses incurred or suffered and any claims or legal proceedings which are brought or threatened, in each case arising from your use of, or conduct on, this site and/or a breach of any of these Terms and Conditions.
